“The new legislation will lead to a focus on managing risks involved with the 'business or undertaking' rather than just a focus on individual hazards. The risk and hazard management process will be more detailed than what we currently have. These management processes will be set out in the supporting Regulations and Code of Practice.

Essentially, businesses will need to:
• Identify and understand the risks involved with conducting their businesses
• Show how they are managing these risks through elimination or minimisation to ensure the health and safety of workers engaged.
How do you describe the different levels of duties?
• PCBU - their primary duty is that they have to ensure the health and safety of workers (as far as reasonably practicable). This will require consideration of factors such as:
- the likelihood of the risk occurring
- the degree of harm
- the availability and suitability of ways to minimise the risk
- the costs associated with available ways with minimising the risks.
• Officer - their primary duty is to exercise due diligence in ensuring the PCBU is meeting its H&S obligations.
• Worker's duty of care - this is a lower level of duty. Workers must take reasonable care for their own health and safety and not act in a way that will adversely affect the safety of others. Workers are also required to comply (as far as reasonably able) with instructions, policies and procedures from the PCBU.
• Duty of care of others - similar to a worker's duty of care, with the exception of cooperating with any reasonable policy or procedure of the PCBU.”
