MK Projects is an established rennovation and new build company with over 30 years’ experience in the construction and joinery industry. This month they are happy to hand out free advice on Building Consents.

A Building Consent is for construction activity and establishes that a planned building work complies with the Building Act 2004 and the Building Code. Anyone building without a building consent may be liable for a fine. They may also have trouble selling or insuring the building in the future. MK Projects advise that they cannot issue building consents retrospectively, although people can apply for a Certificate of Acceptance.

Building work that requires a consent can include any structural building, including new buildings, additions, alteratiions, accessory buildings and re-piling. Heating, ventilation and air conditioning systems will also require a consent, also site works for a building.

Similarly, retaining walls higher than 1.5 metres or retaining walls with a building or driveway near the top, fences higher than 2.5 metres and any swimming pool fence, swimming pools and decks more than 1.5 metres from ground level all require a Building Consent.

A Resource Consent is for any activity that affects the environment. The rules set out as to what activities may or may not need a resource consent are laid out in the district and regional plans of the former councils and the Auckland Unitary Plan.  Auckland Council may take out a range of enforcement actions against people or businesses which break the rules set out in the plans, ranging from infringement notices to prosecution.
