Powerco hearing recommendation accepted in part

Appeal period for Coroglen/Kaimarama transmission line is now open.

 

The next part of the process for the proposed 110kV-capable power transmission line between Coroglen and Kaimarama is underway.

 

Submitters and affected landowners have now been advised by letter that Powerco has made a decision to accept Independent Commissioner, Paul Cooney's recommendation in part.

 

Under Part 8 of the RMA, the process is different to that of a normal land use or subdivision application. Neither Thames-Coromandel District Council (TCDC) nor the Commissioner have authority to make a decision on the Powerco application, but can only make a recommendation on whether Powerco confirm the requirement, modify or withdraw it. Powerco, as the requiring authority, then makes the final decision.

 

Powerco has also notified Thames-Coromandel District Council (TCDC) that it plans to make some minor amendments to the requirement by changing some conditions. A copy of Powerco's decision has been included with the letter sent to submitters and affected landowners, along with a copy of the Commissioner's recommendation.

 

Now that TCDC has notified landowners and occupiers directly affected by the decision, section 174 of the RMA provides an opportunity for TCDC and any person who made a submission to make an appeal to the Environment Court within 15 working days of receiving the latest letter.

 

TCDC has advised those wishing to make an appeal to seek legal advice.
