PLAN CHANGE 7 TO THE OPERATIVE CITY OF NAPIER DISTRICT PLAN

Public notice is given in accordance with Clause 5 of Schedule 1 of the Resource Management Act 1991 that the Napier City Council has prepared the following Plan Change to the Operative City of Napier District Plan.

Plan Change 7: Jervoistown Zone

Plan Change 7 to the Napier District Plan has been developed to address the cumulative eff ects of adhoc subdivision and the subsequent eff ects on existing properties as a result of inadequate servicing in Jervoistown. It is considered that the current rules within the District Plan do not fi t the circumstances of the area. The existing Main Rural Zone provisions are designed to refl ect farming, cropping, horticulture and viticultural activities but these provisions do not sit well with the semi-residential land holdings in the Jervoistown area where the practical use of the land for such purposes is at best extremely limited and not practicable. The existing Rural Settlement Zone recognises the existing pattern of residential development however the level of residential development now occurring is placing pressure on the receiving environment that if left unchecked will result in environmental eff ects that would be more than minor. The purpose of Plan Change 7 is therefore aimed at restricting further development in Jervoistown in order to minimize any further impact on the environment. The primary mechanism for achieving this is to prohibit subdivision in all but limited situations, unless the community agrees they want and will pay for full urban services.

The primary changes proposed in Plan Change 7 relate to:

  • Removing the existing Rural Settlement Zone in Jervoistown and adjusting the Main Rural Zone boundary in Jervoistown.
  • Adding a new zone boundary to be known as the Jervoistown Zone which covers approximately 53 hectares of land situated between the Napier/Hastings Expressway and properties fronting the eastern side of Napier Street, and between Burness Road and a small strip of properties on the south side of Meeanee Road as far east as Basil Road, namely the existing Rural Settlement Zone and part of the Main Rural Zone adjacent to the expressway.
  • Prescribing a minimum lot size of 2500m2 and prohibiting subdivision below this size with the exception of boundary adjustments and subdivision for a network utility operation.
  • Density – 1 dwelling unit per site.
  • Supplementary units and multi unit developments – Discretionary Activity. 
  • Adding a new Objective 33.7 with supporting policies to the Rural Environments section of the Plan to ensure that development in Jervoistown is achieved within the framework of an established structure plan process.
  • Addition of Structure Plans and Procedures for full urban development, including financial contributions for the Jervoistown Zone. 
  • Consequential changes to District Wide sections in Volume 1, Volume 2 - Code of Practice for Subdivision and Land Development and amendments and Volume 3 - Planning Maps, of the District Plan to integrate the new Jervoistown Zone provisions with the rest of the District Plan. Refer to a copy of the Plan Change itself for a full list of the new provisions applying within the zone. This includes activities such as, home occupations, building relocations, retirement complexes, residential care facilities, day care centres, travellers accommodation, education facilities and conditions such as; yards, height, landscaping, open space, noise, light spill, vibration, fencing, aerials, lines and support structures.

Plan Change 7 is available for viewing from Monday 14 May 2012 at the following locations:

Submissions

Any person may make a submission on Plan Change 7. Submissions must be in writing and in the prescribed format (Form 5) of the Resource Management (Forms, Fees & Procedure) Regulations 2003. The closing date for submissions is 5:00pm Friday 22 June 2012.

Public Participation Process After the submission period has closed, the Council will publicly notify a summary of the decisions sought by submitters on Plan Change 7. Public notice will be given inviting any person representing a relevant aspect of the public interest and any person that has an interest on the plan change greater than the interest the general public has, to make a further submission in support or opposition to any of the submissions received. The Council will then hold a hearing of the submissions. All eligible persons who made a submission or further submission and who requested to be heard will be advised when and where their submission will be heard. Every eligible submitter will be notifi ed of the Council’s decision on their submission and the reasons for that decision. Any eligible submitter who is not satisfied with the Council’s decision has the right to appeal the Council’s decision to the Environment Court.
