10 Property Law Act notices (PLA's) to be served in the Waikato by GE Custodians ( BlueChip)

BlueChip victims, members of EUFA, received a phone call this morning from a Private Investigator representing GE Custodians, saying he had a “letter” to deliver.

The EUFA member said from the Waikato this afternoon; “A man phoned and asked if he could bring a letter over from GE.” The server was asked if the special “letter” was a PLA notice and the investigator did not answer but stated the “letter” was about the interest owed to GE.

The couple requested that the caller deal directly with barrister Paul Dale, but he refused insisting the people must comply and accept the document from him by hand.

When the ex Policeman / Private investigator, arrived he served the couple with individual PLA notices.

The victims concerned have reportedly entered into a reverse mortgage agreement with GE and the PLA notice is for a Mortgagee sale, for the Interest owed of around $25,000.
EUFA coordinator Suzanne Edmonds said from Tauranga this afternoon.
“Calling on retired people on a Saturday, under the circumstances that an Appeal is being lodged over the Bartle case, not giving victims the chance to get advice from Paul Dale because it is a weekend, is draconian practice to say the least. These guys are using a strategy, of deliberate manipulative entrapment”

It appears the caller only phoned first as he had to drive 30 minutes to deliver the document and obviously didn’t want to find no one home. In usual circumstance the servers just arrive unannounced. EUFA expect that a much larger amount of notices will be served nationwide.

The Minister of Commerce has not responded to the recent letter from EUFA regarding urgency funding the victims defence against the PLA’s. EUFA are writing today to Ms Rosslyn Noonan, Human Rights Commissioner, laying a complaint over the States failure to ensure insolvent victims, as a result of the BlueChip scam, are provided with their natural right to justice in the form of an adequately defended hearing.

In a recent public discussion paper, the Minister of Justice, Hon Simon Power stated

“Legal aid has a defining role in upholding access to justice. It affords many New Zealanders access to justice, enabling them to defend themselves and to enforce their legal rights. Legal aid is a cornerstone of an accessible, trusted, and effective justice system”

EUFA call on Mr Power to not only talk the talk but walk the walk.

Mrs Edmonds added
“These PLA notices are killing these elderly people.”
