Notice of requirement by Hawke's Bay Airport Ltd

Napier City Council has received a notice of requirement from Hawke’s Bay Airport Limited in respect of the City of Napier District Plan including the Ahuriri Subdistrict.

The requirement is for:

A designation in respect of airspace protection in the vicinity of Hawke’s Bay Airport. The Notice of Requirement proposes to designate airspace to ensure the safe operation of aircraft using the Airport. The designation will restrict the height of buildings, structures, aerials, masts, poles and trees on private property within the designated take off and approach paths and require approval from Hawke’s Bay Airport Ltd should any buildings, structures, aerials, masts, poles or trees penetrate this airspace.

The designation is intended to replace the existing provisions in the District Plan relating to Airport Height Controls due to the extension of the main airport runway and provide the community with certainty as to height limits applicable for all properties within the city.

There is unlikely to be any eff ect for private property owners complying with current permitted height limits in the District Plan unless the permitted height limit is breached and resource consent is required. In this instance approval from Hawke’s Bay Airport Ltd will be required in addition to any resource consent requirements, including the need to obtain a registered surveyors certifi cate verifying compliance with the airport height controls.

Maps of the airspace being designated, including the proposed height restrictions, are included in the notice of requirement, but generally apply north and south of the main airport runway 16-34, and east and west of the crosswind runway 07-25 within that part of the Napier City boundary.

Any person may make a submission on the notice of requirement. Submissions can be made using the Submission Form, which is available at the Planning Department, 2nd Floor, Library Building, Station Street, Napier, or online at www.napier.govt.nz keyword: dpchanges

Public Participation

After the submission period has closed the Council will then hold a hearing of the submissions received on the notice of requirement. All persons who made a submission and who requested to be heard will be advised when and where their submission will be heard. Any submitter who is not satisfi ed with the requiring authority’s decision may refer it to the Environment Court.
