Do You Need A Building Consent?

The Council is responsible for making sure that buildings constructed in Marlborough meet the legal standards.

That means checking that their design and construction methods are safe and will ensure healthy buildings.

The ‘leaky homes’ saga has not emerged as a big problem in Marlborough but it has highlighted the responsibility of local authorities to make certain that buildings meet all the standards.

The law requires that almost all building work requires approval through a building consent. That consent shows the planned building, its plumbing, drainage and safety requirements, will all comply with the Building Code. Consent is required before the work begins.

For some building projects, a resource consent may also be required.

You need a building consent for any of this work:

  • Any structural building including new buildings, additions or alterations, sheds and farm buildings, and re-piling
  • Plumbing and drainage and bridges
  • Relocation of existing structures and some demolitions
  • Fireplaces and wood burners, commercial ventilation and air conditioning systems
  • Retaining walls higher than 1.5 metres, or retaining walls with a building or driveway near the top
  • Fences higher than 2.5 metres
  • Swimming pools and fences
  • Decks more than 1.5 metres from ground level.

The Council can issue consents only if the build work complies with the Building Act 2004 and the Building Code.

Both the Act and the Code are legally binding.

The Council may prosecute where people breach these laws or proceed with work without first getting a building consent.

Some building work does not require a consent but it must still comply with the Building Code and people are urged to seek advice, from the Council or building professionals, before going ahead.
