The Napier City Public Places Liquor Control Bylaw 2004

PROHIBITS THE CONSUMPTION, BRINGING IN AND POSSESSION OF INTOXICATING LIQUOR from 11.00am to 12 Midnight on SATURDAY 5TH NOVEMBER 2011 in the following PUBLIC PLACES:

  • Church Road - from Tironui Road to Kent Terrace
  • Tironui Reserve - All of the reserve
  • Tironui Drive - full length
  • Pukekura Place - full length
  • Kent Terrace - full length
  • Ewan Place - full length
  • Cumberland Rise - full length

 

It is an offence to consume, bring in or be in possession of any intoxicating liquor in the public places subject of the prohibition from

11.00 am to 12 Midnight on SATURDAY 5th NOVEMBER 2011 for CHURCH ROAD CONCERT

During the prohibition the Police may, pursuant to sec. 169(2) of the Local Government Act 2002, without a warrant search any vehicle or container, and seize and remove any liquor and arrest any offender. Before exercising this power of search, a member of the Police must:

  • Inform the person in possession of the vehicle or container that he or she has the opportunity of removing the vehicle or container from the Public Place; and
  • Provide the person with a reasonable opportunity to do so.

 

THE MAXIMUM FINE UPON CONVICTION OF ANY OFFENCE AGAINST THIS BYLAW IS $20,000
