NAPIER

The Napier City Public Places Liquor Control Bylaw 2004

Prohibits the consumption, bringing in and possession of intoxicating liquor at any time, on any day from 18 January 2012 to 17 May 2012, in the following public places:

  • Kennedy Road from the intersection with Nuffield Avenue through to the intersection with Georges Drive.
  • Nuffield Avenue from the intersection with Kennedy Road through to the intersection with the Service Lane behind the Marewa shopping centre.
  • The full length of the service lane behind the Marewa shopping centre.
  • Bedford Road from the intersection with Douglas McLean Avenue through to the southern boundary of number 4 Bedford Road.
  • Douglas McLean Avenue from the intersection with Higgins Street through to the south-eastern boundary of 33 Douglas McLean Avenue.

 

It is an offence to consume, bring in or be in possession of any intoxicating liquor in the public places subject of the prohibition from:

At any time on any day from 18 January 2012 to 17 May 2012

During the prohibition the Police may, pursuant to sec. 169(2) of the Local Government Act 2002, without a warrant search any vehicle or container, and seize and remove any liquor and arrest any off ender. Before exercising this power of search, a member of the Police must:

  • Inform the person in possession of the vehicle or container that he or she has the opportunity of removing the vehicle or container from the Public Place; and
  • Provide the person with a reasonable opportunity to do so.

 

THE MAXIMUM FINE UPON CONVICTION OF ANY OFFENCE AGAINST THIS BYLAW IS $20,000
