Judge Edwin Paul of the Auckland District Court has made an Oral Evidence Order requiring Kim Dotcom. body guard Wayne Temparo, lawyer Gregory Towers and the CEO of Sky Tower Casino Nigel Morrison, to appear before the Auckland District Court at to give evidence against the Honorable John Banks.

The next hearing date on 16 September will set a timetable for the proceedings to establish whether or not there is prima facie evidence that Mr Banks knowingly filed a false Local Election Return for his failed 2010 Auckland Mayoralty bid.

The oral evidence hearing is likely to be in November 2013. If set down for trial Banks will be tried in late 2014 just before the General Elections. If convicted he will not be able to stand for Parliament or if elected prior to conviction will loose his seat.

Informant Graham Mc Cready, a candidate for the Eastern Ward in the WCC Local Elections said today."This is a win for open justice in New Zealand in a climate where the Police declined to file the same charge against Banks and have refused to prosecute GCSB for illegal spying on Kim Dotcom."
