Auckland man convicted of making fraudulent ACC claims

ACC has welcomed the conviction of Derek Roy Cornwell in Manukau District Court on Thursday.

Mr Cornwell, of Takanini, was convicted of nine charges, under the Crimes Act and ACC’s own Act.

Between March 2003 and February 2006, Mr Cornwell submitted medical certificates to ACC stating that he was unable to resume any duties, including heavy lifting and bending. During this period he collected a total of $36,927.71 in weekly compensation to cover lost earnings.

However, an ACC investigation revealed that Mr Cornwell was working on various building projects, including building a garage and renovating his dining room.

Mr Cornwell pleaded guilty to the charges and was sentenced to six months community detention, ordered to complete 400 hours of community service and ordered to repay $36,927.71.

“ACC levies are intended to help injured people not fraudsters and ACC has a dedicated investigations unit that works hard to make sure that happens,” said ACC’s General Manager of Claims Management Denise Cosgrove.
