Update on Department of Labour prosecution: Watercare Services Ltd and Canadian Pacific Ltd

AUCKLAND

Following its investigation in to the gas explosion in Onehunga in June 2011, the Department of Labour commenced prosecution action against Watercare Services Ltd and one of its contractors, Canadian Pacific Ltd. The explosion resulted in the death of one worker and a number of injuries to others.

Today both Watercare Services Ltd and Canadian Pacific Ltd entered pleas of not guilty in the Auckland District Court.  The next scheduled court appearance will be in August 2012.

The Department of Labour has filed the following charges:

Watercare Services Ltd:

  • One charge under s6 of the Health and Safety in Employment Act
  • Two charges under s18(1)(a) of the Health and Safety in Employment Act

 

Canadian Pacific Ltd:

  • One charge under s6 of the Health and Safety in Employment Act
  • One charge under s15 of the Health and Safety in Employment Act

 

The Department of Labour is not able to make any further comment while the matter is before the court.
